Welcome to our application, Beverest Life. Thai Beverage Public Company Limited (the “Company”) provides this Application to you, and all users. By using the Application, you agree to the following terms and conditions.
Definitions
- "Application" means the application, named "Beverest Life Application".
- "Content" means all information and contents embodied in the Application, including but not limited to, its source code, text, image, video, audiovisual, sound recording, artwork and design.
- "Indemnified Persons" shall have the meaning as specified in clause "Indemnification" below.
- "Personal Data" means information related to person which can be used in identifying such person whether directly or indirectly, including but not limited to user identification number, name, last name, mobile number, nick name, date of birth, email address, contacting address, social media data, photo kept in the database system of the Company and the Company’s data processor.
- "Users" means all users of the Application.
Using the Application
- The Application will grant you access to the Company’s services linked to the Company’s database which is subject to the Company’s additional terms and conditions. Certain functions of the Application are also subject to additional terms and conditions. You agree to read and understand all relevant additional terms and conditions before deciding to accept such additional terms and conditions.
- The usage objectives of each menu and function can be found in the Application and the information provided to you is for the purpose of usage of the Application only.
- You agree not to use the Application for illegal purpose and/or any purpose which is in violation of laws, rules, regulations, public order, good morals, and/or the terms and conditions set out by the Company and/or any purposes other than those described herein.
Account Security
To use the Application, you can use mobile number or social media account as appeared in the Application to create your account.
You agree that you will not disclose your username or password (PIN) to any person.
Any action performed on the Application under your account is deemed to be performed by you.
You agree to accept the consequences resulting from such action and agree to be responsible for all actions committed under your account, which can be used as evidence by the Company in all circumstances.
If you suspect any unauthorized use of your account, please inform the Company immediately.
Personal Data Protection
For the purpose of developing the Application, Content or any function therein, including improving or adjusting any of the products or services of the Company and/or of any company within Thai Beverage Public Company Limited group of companies (collectively, "Group") or of the Company’s partners or business partners or co-brandings, the Company will collect certain information from you, including but not limited to record of your usage of the Application and your Personal Data, provided by you or by a third party after obtaining your consent, or by the Company’s own collection. In addition, the Company may also disclose the Personal Data and other information to the Company’s partners, business partners, service providers, contractors, sub-contractors who are related to use of the Application in respect of the Personal Data, co-brandings, or organizations relating to sustainability index (including officers, employees, executives, directors, shareholders, agents and advisers of the Group and of recipient of the aforementioned information).
Provided, however, that the Company will only keep your Personal Data for as long as needed to fulfill the aforementioned purposes. Please see further details in the Personal Data Protection Notice of the]]ontent, belong either to the Company or to their respective intellectual property right holders.
You agree, at all times, not to reproduce, adapt, disclose to public or otherwise use, whether in whole or on part, whether with or without remuneration and whether by you or any person, any of the Content unless you obtain prior written permission from its intellectual property right holder or the Company.
Indemnification
If you breach or fail to comply with any term or condition herein, you agree to be responsible for any damage incurred by the Company, the respective intellectual property right holders or any other relevant person or entity (collectively, "Indemnified Persons") and will act in every way to quickly indemnify the Indemnified Persons and abate the damage and/or dispute without any argument that the Indemnified Persons shall be co-responsible in the aforementioned damage and/or dispute, and agree to hold the Indemnified Persons harmless against any claim, damages, expense and any third-party claim including any legal punishment caused by your violation of any term or condition herein.
You agree to fully cooperate with the Indemnified Persons for any litigation and if there is a final judgement by the court that the Indemnified Persons must compensate any injured person, you agree to indemnify the Indemnified Persons for such compensation including all expenses incurred by the Indemnified Persons during the litigation process such as expenses for debt collection, court fees, lawyer fees.
Modifying the Application
The Company is committed to ensure your best experience while using the Application.
Therefore, the Company reserves the right to make changes to and/or modify the Application or any Content or function therein whether wholly or partially for modifying the quality and efficiency of the Application without prior notice to you.
The Application, the Content or any function therein may not be available during such change or modification.
Revising the Terms and Conditions
The Company reserves the right to revise any term and condition herein or any additional term and condition for certain function or service from time to time without prior notice to you.
The revised terms and conditions will take effect immediately after they are posted in App Store or Google Play Store (as the case may be).
You can always check the revised terms and conditions and may review your acceptance of the terms and conditions.
